The Legal Department of the Democratic Front: Condemns U.S. Sanctions on Ms. Francesca Albanese

The sanctions reveal the true nature of the U.S. administration as hostile to law and human rights.
The Legal Department of the Democratic Front for the Liberation of Palestine stated that the United States› imposition of sanctions on the United Nations Special Rapporteur on Human Rights in the Occupied Palestinian Territories, Francesca Albanese, represents the height of disregard for the United Nations and its institutions. It reveals the true face of the U.S. administration as an entity hostile to international law, justice, and human rights — particularly since the justification for the sanctions lies in Ms. Albanese’s fulfilment of her responsibilities in providing the necessary information for UN organizations to carry out their missions effectively, especially the International Criminal Court.
The Legal Department of the Democratic Front believes that the U.S. measures against Ms. Albanese are a natural result of the weakness and paralysis within the United Nations and its various bodies in dealing with international issues, particularly the Palestinian cause. Israel, for example, has previously enacted laws against international organizations (such as UNRWA) and imposed sanctions based on its own domestic legislation, even though these laws are unlawful. The United States has also previously imposed sanctions on several international organizations and their staff (including the International Criminal Court), again based on its domestic laws.
The Department stated that the United States and Israel are working to establish dangerous precedents in the international legal system — namely, the primacy of national laws over international law and international treaties. The U.S. sanctions against Ms. Albanese represent a clear violation of the 1946 Convention on the Privileges and Immunities of the United Nations, especially Articles 4, 5, and 6. These actions also contradict Articles 104 and 105 of the UN Charter, which stipulate that «the Organization shall enjoy in the territory of each of its Members such privileges and immunities as are necessary for the fulfillment of its purposes» and that «Representatives of the Members of the United Nations and officials of the Organization shall similarly enjoy such privileges and immunities as are necessary for the independent exercise of their functions.»
The Legal Department of the Democratic Front for the Liberation of Palestine concluded by stating: Although the international community, represented by members of the Human Rights Council, responded clearly and directly to the U.S. and Israeli positions calling on the Secretary-General to dismiss Ms. Albanese — by voting last April to extend her mandate until 2028 despite Israeli, Hungarian, Argentine, and pro-Israel organizations’ efforts to obstruct the decision — the nations of the world, along with human rights and humanitarian organizations, are called upon to condemn the U.S. action, reject the policy of bullying and the imposition of the law of the jungle by the U.S. administration, and support Ms. Albanese’s positions. Her efforts bring to light the tragic reality faced by the Palestinian people in Gaza and the West Bank due to the terrorism perpetrated by Israeli fascism — a reality that demands greater international efforts to hold Israel accountable for its crimes and ensure that its leaders face justice in international courts.
